International Council of Shopping Centers (ICSC) Law Conference

On Friday, October 16, 2020, Lewis Rice member Mark D. Eisemann and Honigan LLP partner Jonathan Block presented at the International Council of Shopping Centers (ICSC) Law Conference. The seminar addressed issues related to the creation, development, leasing, and sale of outlots as part of a new shopping center, the carve-out of outlots from an existing shopping center, and the redevelopment, releasing and resale of existing outlots.

Topics included design criteria, construction controls, parking requirements, permitted uses, use restrictions, exclusives, signage, lender approvals, partial release of mortgages, cross-easements, common area cost sharing, amendments to underlying documents, approval rights under existing declarations, and repurchase rights.
