Sea of Parking or See Some Customers? – Creating, Developing and Redeveloping Outlots in a Shopping Center

The seminar addressed issues related to the creation, development, leasing, and sale of outlots as part of a new shopping center, the carve-out of outlots from an existing shopping center, and the redevelopment, releasing and resale of existing outlots.
Topics included design criteria, construction controls, parking requirements, permitted uses, use restrictions, exclusives, signage, lender approvals, partial release of mortgages, cross-easements, common area cost sharing, amendments to underlying documents, approval rights under existing declarations, and repurchase rights.

Mark Eisemann is Vice-Chair of the Real Estate Department of Lewis Rice LLC in Kansas City. His practice encompasses all aspects of real estate development, with an emphasis in theatre and retail leasing. Mark is familiar with the competing interests of landlords, tenants and lenders, including in mixed use developments and redevelopment projects.
