IT Sourcing Disputes

The very nature of outsourcing lends itself to disputes. Customers often give providers control of IT employees, IT assets, and vital IT systems; providers often make significant long term capital investments based on assumptions in an ever-changing and sometimes unpredictable IT environment and rely on complicated billing systems to generate invoices that are not easily understood. While achieving amicable resolutions to disputes is always preferred, sometimes litigation/arbitration cannot be avoided. Our team has extensive experience in successfully prosecuting and defending arbitrations arising from outsourcing transactions. Because most arbitrations begin during the outsourcing relationship, a coordinated and integrated approach to managing the on-going relationship and the arbitration is essential. Our team specializes in just that. Additionally, the Information Technology Practice Group's arbitration experience and understanding of disputes allows us to better advise our clients in the negotiation, implementation, and management of the outsourcing transaction.
